At Moran Law Offices, we understand the financial stress and worry that our clients are experiencing, and we promise to do our best to help eliminate that stress and worry. As part of that promise, we are always transparent, up front and honest about the fees we charge.
Below is a schedule of the costs involved with filing a bankruptcy, from the legal fees to the filing and credit counseling fees. Our office can be retained for as little as $50.00,
which is applied toward a client's balance and allows clients to stop the harassing creditor calls by referring them to our office.
We also offer clients easy payment plans that allow clients to pay a monthly amount they can afford toward their case.
FEES FOR CHAPTER 7 BANKRUPTCY
Legal Fees
At Moran Law Offices, we understand the importance of keeping legal fees at an affordable level, in fact we pride ourselves on offering the best service available at prices that are among the most competitive in the state. Our Chapter 7 bankruptcy legal fees range from $700.00 to $1,500.00 for the vast majority of cases that we file.
Factors that weigh in favor of a lower legal fee ($700-$900) are:
- Below median income
- Not owning a home
- Less than $20,000 of debt
Factors that weigh in favor of a higher legal fee ($1,300-$1,500) are:
- Above median income
- Self-employment/business income
- Multiple homes
- More than $40,000 of debt
The average cost of the legal fees for a Chapter 7 case are $1,000.00.
(The legal fees described above apply to approximately 80% of our clients. Moran Law reserves the right to charge more or less for a particular case depending on an individual's circumstances).
Incidental Costs
The two other costs that most of our clients incur are the Bankruptcy Court filing fee of $306.00 and credit counseling costs of around $9.95 (credit counseling costs can vary depending on the credit counseling provider). The Court filing fees can be waived if an individual's income and assets are below a certain threshold.
Total Cost Involved
The average total out of pocket cost for a Chapter 7 client will be $1,315.95. This includes all fees and costs.
FEES FOR CHAPTER 13 BANKRUPTCY
Legal fees
The legal fees in a Chapter 13 case range from $1,500.00 to $3,500.00 depending on the complexity of the case, the types of debts that a client will
be paying through the plan, and whether or not a lien-strip is filed (lien-strips are a process of removing second mortgages and home-equity lines
of credit from a client's home).
Fortunately for clients, our office is paid the majority of the legal fees through the Chapter 13 plan and not by the client directly.
Normally, a client is required only to pay a total of between $781.00 in order to get a case filed. The remainder of the fees are
paid to us by the Chapter 13 Trustee during the duration of the plan. Because our office chooses to be paid by the Trustee, the legal fees will
almost never increase a client's monthly plan payment.
Incidental Costs
As with a Chapter 7 case, a Chapter 13 case also requires a filing fee to be paid to the Court. The Chapter 13 court filing fee is $281.00.
As in Chapter 7 cases, clients are also required to complete a credit counseling course and a debtor education course, the fees for these
courses are approximately $9.95 combined, depending on the company used. The provider we recommend at our office is DebtorCC (www.debtorcc.org).
Total Cost Involved
The average total out of pocket cost for a Chapter 13 client will be approximately $781.00, which equates to $500.00 filing fee and a $281.00 filing fee, the remainder of any fees would be paid through the Chapter 13 plan as part of the monthly plan payment.
